The International Comparative Legal Guide to: Patents, 7th edition, is a Q&A-style guide to patent law in 28 jurisdictions worldwide. The Thailand chapter of the guide, contributed by Tilleke & Gibbins, provides an overview of the following subjects:

  • Enforcement: Criminal and civil proceedings, court filing fees, time frames, document disclosure under the Civil Procedure Code, pre-trial procedures, scope of a patent, defense of patent invalidity, preliminary and final injunctions, forms of relief for patent infringement, appeals, and typical costs of first instance judgment proceedings.
  • Amendment: Amending a patent ex parte after grant, amending a patent in inter partes revocation/invalidity proceedings, and constraints.
  • Licensing: Limitations on licensing terms and compulsory licenses under Thailand’s TRIPS obligations.
  • Prosecution and opposition: Patentable subject matter, examiner’s entitlement to request any documents from applicants, oppositions by third parties, appealing a decision of the Patent Office, disputes over entitlement to priority and ownership of an invention, grace period for filing an invention patent, and term of a patent.
