Asia IP Ranks Tilleke & Gibbins in “Tier 1” for Trademarks in Thailand

Asia IP

Tilleke & Gibbins has been ranked in “Tier 1” for “Trademark Prosecution” and “Trademark Contentious” work in Thailand by Asia IP  in the magazine’s Trademark Survey 2015. Only the leading trademark practices around Asia are included in the survey.

The ranking’s editorial quotes Darani Vachanavuttivong, co-managing partner and managing director of the intellectual property department at Tilleke & Gibbins, for her views on the revisions to Thailand’s Trademark Act. “One of the key issues of concern to trademark owners is when companies refill a brand owner’s genuine containers with the company’s own products in order to mislead consumers in regard to the origin of the goods,” she said. “In order to address this serious counterfeiting issue, the proposed amendments to the Trademark Act include a new provision on refilling.”

Commenting on the long pendency periods for trademark and design registrations, Darani said, “numerous office actions and granting of trademark and design applications have been issued to clear the backlog in the past five months.” In addition, “the director general has requested more than 80 patent examiners to join the team, which is awaiting government approval,” she said, meaning that “once the new examiners are added, the patent examination process will be expedited.”
