Lex Mundi Webinar: Pharmaceutical Patent Litigation in Thailand and Vietnam

Lex Mundi

Thailand’s pharmaceutical industry is one of the largest and most developed in Southeast Asia—the country’s unique universal medical scheme and its position as a hub of regional distribution have formed a highly attractive market. Vietnam’s pharmaceutical industry, while less developed, is one of the fastest growing markets in Asia. Both of these countries are attracting some of the biggest players in the pharmaceutical industry; but as with any positive, there is a negative—as business flourishes, so does the prevalence of infringement. Therefore, those in the pharmaceutical industry must be well versed in pre-litigation strategies and evidence gathering to effectively deal with unfair competition, infringers, and matters involving litigation.

To discuss these issues and more, Alan Adcock, Siraprapha Rungpry, Thomas Treutler, and Loc Xuan Le of Tilleke & Gibbins’ Thailand and Vietnam offices will participate in a webinar titled “Pharmaceutical Patent Litigation in Thailand and Vietnam,” hosted by Lex Mundi. Together, they will delve into the following main subjects:

  • Overview of patent litigation system
  • Preliminary measures: Drafting C&D letter/Dear Doctor letter/Communication with infringers and customers
  • Considering possible preliminary and interim reliefs
  • Considering types of action: Criminal or civil action?
  • Avoiding chain of custody issues over gathered evidence and analysis reports
  • Preparing for litigation: Patent validity analysis/infringement analysis
  • Roles of expert witnesses: Foreign or domestic?
  • Preparing evidence with regard to damages

Lex Mundi is the world’s leading association of independent law firms. The webinar will take place on October 29 at 9 p.m. Bangkok time. If you would like to learn more, please visit the Lex Mundi website.
