Biography

Waewpen Piemwichai is a counsel in the Tilleke & Gibbins corporate and commercial group, based in the Hanoi office. She leads the firm’s active technology, media, and telecommunications (TMT) practice in Vietnam and, together with her team, advises companies from all industry sectors on TMT-related matters such as data privacy, cybersecurity, telecom and IT network services, online streaming and broadcasting, cloud computing, e-commerce, and advertising. Outside the TMT space, Waewpen also has extensive experience and expertise in practice areas including commercial transactions, franchising, company formation, and construction.

Waewpen was named “TMT Rising Star of the Year” at the 2023 Legal 500 Southeast Asia Awards, and has also been named one of Asia’s “Top 15 Rising Lawyers” (2021) and “Top 15 TMT Lawyers” (2022 and 2023) by Asian Legal Business. She is ranked as a leading TMT lawyer in Vietnam by Chambers Asia-Pacific and The Legal 500, and was named the “highest rated lawyer to work with” for TMT in Vietnam in the 2021 Asialaw Client Service Excellence ratings.

Waewpen is a member of the Thai Bar Association, and was based in Bangkok before relocating to the firm’s Hanoi office. She is the firm’s Vietnam office contact person for Thai-speaking clients.

Experience

  • Regularly advise and assist a social media giant with numerous legal issues concerning the company’s social network operation and new initiatives in Vietnam. This advice has covered technical and corporate matters ranging from restrictions on video content to free VoIP services to charitable fundraising activities.
  • Advised one of the world’s largest cryptocurrency exchanges to conduct a comprehensive analysis of the laws and regulations, licensing requirements, and restrictions applicable to its proposed launch of a copy trading product in Vietnam.
  • Advised a NYSE-listed satellite communications company on regulatory requirements applicable to its proposed offering of mobile satellite services and relevant communication devices to customers in Vietnam.
  • Advised a major computer manufacturer on product recall regulations in Vietnam for a laptop computer line and helped to prepare the notification forms for the Vietnam Competition Authority as well as the Vietnam Aviation Authority.
  • Advised a global design and architecture firm on provision of cross-border architectural services to construction project developers in Vietnam, and assisted the client in obtaining, revising, and providing annual reports on Construction Operating Permits (COP) for several high-profile projects in Vietnam.
  • Conducted due diligence and gap analysis on data privacy and data security practices of a computer hardware manufacturer’s entire operation in Vietnam.
  • Advised a multinational technology corporation on regulatory issues related to the company’s plan to light its own fiber, both terrestrial and subsea fiber, and to build its own subsea capacity in order to connect its global cloud services network.
  • Advised many world-leading data communications and telecommunications equipment providers to expand businesses into Vietnam, including IT system consultation and integration services; provision of infrastructure for cloud computing services; remote management of calls over cloud; distribution and lease of IT/telecommunication equipment; and Internet access services.
  • Advised and assisted a Thai pharmaceutical company to successfully transfer employees and additionally employ staff to work in its Vietnam affiliates.
  • Served as local counsel to a global telecommunications company in acquiring optical business in Thailand, reviewed business transfer agreement and advised on all aspects of doing business in Thailand, including formation and operation of a new company, investment promotion, foreign business license for distributing and servicing of optical network equipment to mobile network operators, employment, and customs.
  • Served as local counsel and corporate secretary to a leading Swedish defense company and its Thai subsidiary; assisted the client with a project supplying fighter aircraft and military systems to the Royal Thai Navy and advised on diverse corporate matters, including company and share restructuring, legal compliance, and immigration for engineers and executives.
  • Advised a Japanese global manufacturer of electric appliances to acquire shares and majority control in its joint venture company.
  • Advised clients from various industries to set up their presences in Thailand and apply for Foreign Business License and/or investment promotion, including a leading Korean company for participation in a construction project for an offshore petroleum drilling platform, U.S. pharmaceutical companies, Japanese automotive part manufacturers, a U.K. insurance company, and an Australian securities company.
  • Advised clients from various industries in conversion of corporate structure from private limited company to a public company and list securities on the Market for Alternative Investment (MAI) stock exchange.
  • Advised a major telecommunications investor in bidding with the government authority for a license to operate mobile phone services.
  • Advised airlines from Korea and Austria in relation to quotas for international flight schedules.
