Tilleke & Gibbins facilitates trade and commerce in Southeast Asia by serving Asia-based regional transportation and logistics providers as well as multinational providers operating in Asia. We also represent importers and exporters of all types including manufacturers, distributors, and retailers.

Our diverse clients rely on our strategic counsel on supply chain management. In addition, we advise on aviation transport, inland transport, maritime issues, multimodal transport, customs, and insurance, including casualty insurance, life insurance, and marine insurance. As business-oriented practitioners, we assist our clients in resolving such practical issues as language, geographic, and cultural differences.  

Over the last 120 years, our practice has evolved along with the regional and global dynamics of transport—from representing unimodal transport providers to global companies providing integrated logistics and transportation services. We have a long history of helping clients overcome trade barriers and increase their competitiveness in Southeast Asia.

Among our recent matters, we have:

  • Defended a leading global logistics company in three separate criminal actions brought by the Thai Customs Department with potential fines in excess of USD 15,000,000. After a defense put forth at the prosecutorial review stage, the Public Prosecutor issued non-prosecution orders in favor of our client. These orders have since been confirmed and this case is final.

  • Liaised with Thai Customs, on behalf of our client, to resolve a charge of a false declaration related to the import of a hazardous substance. We also advised our client on the applicable import laws.

  • Defended a logistics company against an insurance claim in the amount of over THB 1,300,000. We successfully argued that our client should only pay in accordance with its liability limits and saved the client over THB 1,000,000.

  • Assisted in structuring an airline alliance. As two major international carriers were organizing a joint venture, the firm was approached to assist. The joint venture is now in operation, and has helped to position both carriers for improved profitability.

  • Advised a coalition of European banks regarding Vietnamese law on secured aircraft finance and provided annual updates on changes to same.

  • Completed, on behalf of a client, the purchase of Thai-flagged cargo vessels by preparing all transfer documents, assisting in the transfer of ownership, and obtaining all related documentation, such as deletion certificates.

  • Prepared industry-specific contracts, such as aircraft service agreements and air transport service agreements, for a local aviation company.

  • Secured the dismissal of a large cargo claim brought by a joint-venture insurance company against a domestic freight forwarder. We successfully proved that our client was not liable because our client was not a carrier or actual carrier of goods. The court dismissed the plaintiff’s claim against our client.

  • Proved that our client was innocent in the critical appeal of a criminal case. The court of first instance ruled that our client, the head of a company commissioned to tow a historical submarine from Europe to Asia, committed fraud and assessed a lengthy term of imprisonment. We zealously appealed this judgment. Our persuasive arguments led the appellate court to conclude that our client’s innocence was proven beyond a reasonable doubt.

  • Represented a multinational air carrier in litigation involving cargo damages and prevailed against a global insurance company.

  • Successfully defended one of the world’s leading liner companies against multiple cargo claims brought in Thailand’s Intellectual Property and International Trade Court.

  • Represented a subsidiary of a global multimodal transportation provider in a case worth THB 24,000,000. Secured emergency relief in Thailand’s Intellectual Property and International Trade Court, allowing the client to remove the cargo from its vessel.

  • Secured a victory in Thailand’s Supreme Court on behalf of an ocean common carrier for damage to a vessel due to defective product packaging.

  • Represented a leading investment company operating in the transport sector in a high-profile tort action with a total value of over THB 50,000,000. This case is currently pending in Thailand’s Supreme Court.
