Technology, Media, and Telecommunications

Tilleke & Gibbins helps cutting-edge players in the high-technology, media, and telecommunications industries shape and succeed in the creative economies of Southeast Asia. We specialize in defining strategic and business objectives, negotiating contracts, managing disputes, and capitalizing on technology acquisitions and capabilities to create new market opportunities.

Our dynamic Technology, Media, and Telecommunications (TMT) team is headed by Jeffrey J. Blatt. Jeffrey leveraged his many years representing high-profile clients in Silicon Valley and Hollywood to become a leading practitioner in Asia’s TMT sector. Since 1981, Jeffrey has represented new economy businesses in the fields of satellite direct-to-home (DTH) pay television broadcasting, cable and iPTV systems, telecommunications and GSM, GPRS, 3G mobile technology acquisition, computer systems and software, semiconductors, multimedia, motion picture production and special effects, the Internet, and satellite systems.

The TMT group and the intellectual property (IP) group work in tandem to protect innovation, including ensuring the clearance and licensing of intellectual property as it relates to film, television, radio, and Internet content. Both our TMT and IP groups are recognized as leading practices by publications such as The Legal 500 Asia Pacific.

Read about our recent representation of companies that define, lead, and revolutionize the fields of electronics, software, entertainment, and Internet services. Our TMT group:

  • Represented a major U.S. telecommunications and software vendor in negotiations with five Thai mobile telecom operators to deploy mobile number portability (MNP) in Thailand. We successfully negotiated the deal to full deployment, which included a build operate and agreed optional transfer build out, as well as handled the formation of the client’s Thai subsidiary and associated visa/work permits and required Thai bank guarantees. MNP is now up and available in Thailand.

  • Conducted due diligence on behalf of a financial institution considering whether to finance the build out of a state-owned operator’s planned 3G network in Thailand and advised the financial institution regarding risk factors. The proposed loan amount as publically disclosed exceeded USD 500,000,000.

  • Advised a consortium of financial institutions on telecommunications laws in connection with their bids to provide credit facilities (totaling THB 15.85 billion) to a major telecommunications operator for the expansion of a 3G mobile network and infrastructure.

  • Advised a global technology company on the launch of a network game platform in Thailand; including counseling on censorship and obscenity laws.

  • Advised a leading global Internet brand and an international video game company on website development, Internet services, and the legal implications of same.

  • Advised a Japanese-Chinese joint venture on the regional broadcast distribution of an animated television series, including advising on intellectual property assignment and registration in preparation for licensing and merchandising opportunities.

  • Assisted a producer of real-time strategy games with the launch of their latest offering in Thailand. Much of our work focused on localizing business approaches and terms of use. The game went on to meet with considerable success, both in Thailand and overseas.

  • Advised a multinational media company on a regional copyright dispute in the broadcasting field.

  • Advised a leader in wireless technology on government authorities related to the telecommunications industry.

  • Liaised with the Ministry of Information and Communication Technology (MICT) on behalf of our client, an operator of a social-media website, to ensure compliance with the Computer Crime Act and, as a result, successfully prevented the website from being banned by the MICT.

  • Helped a multinational company establish a foreign direct investment company engaged in the import/export and distribution of mobile phones and computers.  The established company is one of the few foreign-owned companies permitted to do business in this sector in Vietnam.

  • Provided in-depth advice to a global software solutions provider on doing business in Vietnam.
